Take Action to Save Mothers’ Lives
Mothers’ advocacy group supports clarification of existing laws 
that will save mothers during pregnancy emergencies

 

(AUSTIN, Texas) –  Texas Campaign for Mothers (TCM) applauds Sen. Bryan Hughes (R – Mineola) and Rep. Charlie Geren (R-Lake Worth) for filing The Life of the Mother Act (Senate Bill 31/House Bill 44). The bill intends to clarify Texas abortion laws to ensure that the lives of mothers are protected during a medical emergency. SB 31/HB 44 provides physicians with clear legal definitions, allowing them to make necessary medical decisions without fear of unwarranted legal or financial consequences. TCM supports this important step toward ensuring the best medical outcomes for pregnant women with medical complications across the state.

“This is as consequential as any bill I have ever worked on,” said Rep. Geren. “It safeguards the Texas I know and love, one where mothers are valued and protected. Sen. Hughes and I are confident we have clarified any misunderstandings regarding medically necessary decisions.”

The Life of the Mother Act maintains Texas’ current prohibitions against abortions while clarifying the medical emergency exception to cover threats to the mother’s life or major bodily functions.

“Texas mothers are the lifeblood of Texas families and deserve the best and safest medical care throughout their pregnancy, delivery and to protect their future fertility,” said Danielle Rugoff, Chief Advocacy Officer for Texas Campaign for Mothers. “When heartbreaking medical complications that affect the lives of the mother or baby arise, doctors must have the legal clarity to act as necessary to provide life-saving care. We are grateful to Sen. Hughes’ and Rep. Geren’s commitment to clarify the existing laws to ensure Texas mothers have access to evidence-based, lifesaving care.”

SB 31/HB 44 updates the burden of proof needed for bringing a claim against a physician, addressing the chilling effect and fear of prosecution that has caused doctors to leave the state and medical residents to bypass Texas. The legislation also introduces a requirement for the Texas Medical Board and the State Bar of Texas to offer education courses that increase the understanding of the legal/medical professions regarding the laws regulating abortion.

“We’re glad that the clarification of these laws will help us bring back physicians to care for Texas mothers and alleviate the growing maternal health deserts in rural Texas,” Rugoff said. “The Life of the Mother Act shows Texas’ commitment to supporting families and mothers by clarifying the existing laws to ensure that every pregnant mom is given the care she needs.”
